TERMS AND CONDITIONS

Mishku Studio | Custom Line Portrait Commissions

Please read the following terms carefully before commissioning your portrait. By accepting your quote and completing payment, you acknowledge and agree to these terms.

1. Custom Artwork & Artistic Interpretation

Every portrait is individually hand-drawn by Michelle Kunitoshi Browne using digital drawing tools. No generative AI, automated photo filters or automatic illustration software are used in creating the artwork.

Each illustration is created in my signature artistic style, with a focus on expressive, organic linework and simplicity.

Portraits are artistic interpretations of supplied photographs rather than exact photographic reproductions. Certain details may be simplified, omitted or interpreted according to my creative judgement.

By commissioning a portrait, you acknowledge that you are familiar with my illustration style and understand that the finished artwork will reflect this approach.

The finished illustration is professionally printed onto Gmund Ivory Cotton 370gsm paper. The purchase includes a physical fine art print, not an original drawing on paper or a digital artwork file.

2. Reference Photographs

The standard commission price includes illustration from one supplied photograph.

Please choose your photograph carefully, considering the composition, expressions and positioning of the subjects.

Requests to combine people or pets from multiple photographs, change the composition or add additional subjects may incur an additional fee.

These requests must be discussed and agreed upon before the illustration begins.

Clients are responsible for ensuring they have the necessary rights or permissions to supply their photographs for use as illustration references.

3. Portrait Inclusions & Pricing

Standard portrait pricing begins at $170 AUD and includes one of the following:

  • Up to three people

  • Two adults and two children

  • Two adults and one pet

Print prices are:

  • A5: $170 AUD

  • A4: $180 AUD

  • A3: $190 AUD

Additional subjects, pets, complex compositions or combining photographs may incur additional charges, which will be quoted before work begins.

Prices exclude postage and framing.

4. Revisions & Alterations

The standard commission price does not include complimentary revisions.

Once the illustration has been completed, requests to alter or adjust the artwork will incur an additional revision fee, quoted according to the nature and complexity of the requested changes.

Revisions may include minor adjustments to details within the agreed composition.

Requests to change the original reference photograph, significantly alter the composition, add or replace subjects, or substantially redraw the artwork are not considered minor revisions and may require a separate quote.

All additional fees must be agreed upon before further work is undertaken.

Any corrections required because the artwork does not meet the agreed specifications or applicable consumer guarantees will be addressed in accordance with Australian Consumer Law.

5. Enquiries, Payment, Cancellations & Refunds

All portrait commissions begin with the submission of a request form.

Submitting a request does not constitute a confirmed order or guarantee acceptance of a commission.

After reviewing your reference photograph and requirements, I will provide an invoice outlining the total cost of your portrait, any applicable additional illustration fees and your selected shipping option.

Full payment is required to confirm your commission and secure your place in my illustration schedule. No illustration work will begin until payment has been received.

Due to the individually commissioned and personalised nature of the artwork, change-of-mind cancellations and refunds are not offered once payment has been made.

Please ensure you are happy with your chosen photograph, composition, print size and invoice details before completing payment.

Nothing in these terms excludes, restricts or modifies your rights under Australian Consumer Law, including any entitlement to a remedy where applicable consumer guarantees have not been met.

6. Printing, Paper & Framing

All portraits are printed on Gmund Ivory Cotton 370gsm, a heavyweight, subtly textured paper with a warm ivory tone.

The physical appearance of the finished print may vary slightly from the digital artwork displayed on a screen due to paper texture, natural paper colour and differences in screen calibration.

All prints are supplied unframed.

Clients are responsible for ensuring they select a suitable print size for their intended frame.

If you have specific frame dimensions or require additional spacing around the illustration, please communicate this before work begins.

I recommend choosing a print slightly larger than your intended frame opening where possible, allowing the paper to be trimmed to size.

7. Shipping & Delivery

Shipping costs are additional and will be confirmed before payment.

All prints are carefully packaged to help protect them during transit.

Clients are responsible for supplying an accurate and complete delivery address.

Once dispatched, shipping and delivery are managed by the relevant postal or courier provider. Delivery timeframes are estimates and may be subject to postal delays.

While I cannot guarantee postal delivery timeframes or prevent disruptions outside my control, please contact me if your order is delayed, lost or damaged in transit so the matter can be investigated and resolved appropriately.

Any responsibility for loss, damage or non-delivery will be addressed in accordance with applicable Australian Consumer Law obligations.

8. Copyright, Ownership & Personal Use Only

All custom portraits are commissioned and sold strictly for personal, non-commercial use only.

The purchase of a portrait provides ownership of the physical print only. It does not transfer copyright or intellectual property ownership in the illustration.

All copyright and intellectual property rights in the artwork remain with Michelle Kunitoshi Browne of Mishku Studio.

No commercial licence, reproduction rights or rights to create derivative works are granted as part of a standard portrait commission.

Permitted Personal Use

Clients may:

  • Display the physical portrait in their home or another private, non-commercial setting.

  • Give the physical portrait as a personal gift.

  • Share photographs of the finished portrait on personal, non-commercial social media accounts, provided the artwork is not being used to advertise or promote a business, product or service.

Prohibited Commercial Use

Without prior written permission and an appropriate commercial licensing agreement, clients may not:

  • Use the illustration as a business logo, brand identity, brand illustration or other visual business asset.

  • Reproduce the illustration on business cards, websites, packaging, promotional materials, advertisements or marketing collateral.

  • Use the artwork on business or professional social media accounts for promotional or commercial purposes.

  • Reproduce the artwork on merchandise or products, including clothing, tote bags, stationery, greeting cards, mugs, posters or homewares.

  • Sell, manufacture or distribute products featuring the illustration, whether for profit or otherwise in connection with a commercial activity.

  • Use the illustration for commercial gifts, promotional giveaways, client gifts or branded materials.

  • Include the artwork in books, magazines, publications, digital products or other commercially distributed material.

  • Sell, license, sublicense, distribute or otherwise commercially exploit the artwork or reproductions of it.

  • Provide the artwork to another business, designer, printer, manufacturer or third party for unauthorised reproduction or commercial use.

  • Trace, redraw, modify or adapt the illustration to create another artwork, logo, graphic or product for commercial purposes.

  • Use the illustration in connection with NFTs, generative AI training datasets or AI-generated derivative works.

These restrictions apply regardless of whether the artwork is reproduced in its original form or has been modified, recoloured, cropped, traced or adapted.

Personal gifting does not transfer commercial rights. If a portrait is purchased as a gift, the recipient receives the same limited personal-use permissions as the original purchaser.

Commercial Licensing

If you would like to use an illustration for a business, brand, publication, product, merchandise or another commercial purpose, please enquire separately before commissioning.

Commercial illustration projects are subject to separate pricing, licensing arrangements and written agreements based on their intended usage, distribution and scope.

No commercial use is authorised unless expressly agreed upon in writing.

9. Digital Files & Reproduction

The commission includes one physical fine art print in the selected size.

Digital source files, high-resolution artwork files, editable illustrations and reproduction-ready files are not included.

Clients may not scan, photograph or digitally reproduce the illustration for the purpose of making additional prints, products or copies for distribution without prior written permission, except where permitted by law.

Any requests for additional physical prints must be arranged separately.

10. Acceptance of Terms

By accepting your quote and paying your portrait invoice, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

You understand that the illustration is a custom, digitally hand-drawn artwork, professionally printed for personal use only, and that copyright and commercial reproduction rights remain with the artist.

Nothing in these terms excludes, restricts or modifies any rights that cannot lawfully be excluded under Australian Consumer Law.

Thank you for supporting my work and allowing me to create something personal for you. It's a lovely privilege to turn your photographs and memories into something tangible.

With warmth,

Michelle
