Terms and Conditions of Sale

The Aligned Creative Circle – 12-Week Creative Mentoring Program
Effective Date: 4th June 2025

These Terms and Conditions (“Agreement”) govern your participation in The Aligned Creative Circle (“Program”) offered by Mishku Studio ABN 20543321833, operated by Michelle Browne (“Company”, “we”, “us”, or “our”). By enrolling in the Program, you (“Participant”, “you”, or “your”) agree to be bound by this Agreement.

1. Program Description

Program starts on the 21st of July 2025 and ends 21 October 2025

The Program is a 12-week group mentoring container that includes:

  • Six (6) live group mentoring sessions

  • Two (2) co-working or creative integration sessions

  • Access to a private online community for the duration of the program

  • A Notion portal

  • One (1) brand voice audit

  • One (1) bonus 1:1 session (for eligible early bird participants)

  • Two (2 total) bonus 1:1 sessions (for eligible fast action workshop participants)

  • Access to program recordings for 6 months after recording

  • Lifetime access to Notion portal

All calls are conducted via video conferencing software (e.g., Zoom) and scheduled in advance.

2. Fees and Payment

2.1 Fees: The total fee for the Program is as stated at the time of purchase
2.2 Payment Terms: You may pay in full $1497 USD or via the designated payment plan 4x monthly payments of $425 USD. By choosing the payment plan, you agree to make all scheduled payments in full and on time.
2.3 Non-Refundable: All payments are final and non-refundable. Due to the digital and time-limited nature of the Program, no refunds will be issued under any circumstances, including partial attendance, withdrawal, or dissatisfaction.
2.4 Failure to Pay: In the event of a failed or missed payment, access to the Program may be suspended until payments are brought up to date.

3. Participant Obligations

3.1 Participation: You are expected to attend live sessions where possible and participate actively. Access to recordings will be provided.
3.2 Conduct: You agree to participate in a respectful, non-disruptive manner. Harassment, abuse, or inappropriate behaviour may result in immediate termination of your access without refund.
3.3 Confidentiality: You agree to maintain the confidentiality of any personal or business information shared by other participants during the Program. Breaches may result in removal without refund.

4. Intellectual Property

4.1 Ownership: All content, including videos, templates, resources, and written materials, is the intellectual property of Mishku Studio and is protected by copyright law.
4.2 License: You are granted a limited, non-exclusive, non-transferable license to use the Program materials for your personal use only.
4.3 Restrictions: You may not share, reproduce, distribute, sell, or publicly display any part of the Program content without prior written consent.

5. Changes & Cancellation

5.1 The workshop schedule and content are subject to change. We reserve the right to make necessary adjustments and will inform participants of any significant changes.
5.2. There may be circumstances in which we need to postpone the program; if we do, we will advise you of this as soon as possible.
5.3 There may be circumstances in which we need to cancel the program. In such circumstances, we will provide you with a full refund of the amount of the Registration Fee that you have paid to us and we will make very effort to provide you with such refund within 60 days of the date of cancellation.

6. Disclaimer and Limitation of Liability

6.1 No Guarantees of Results: YOUR SUCCESS DEPENDS ENTIRELY ON YOUR OWN EFFORT, MOTIVATION, COMMITMENT AND FOLLOW-THROUGH. WE CANNOT PREDICT AND WE DO NOT GUARANTEE THAT YOU WILL ATTAIN A PARTICULAR RESULT, AND YOU ACCEPT AND UNDERSTAND THAT RESULTS DIFFER FOR EACH INDIVIDUAL. EACH INDIVIDUAL’S RESULTS DEPEND ON HIS OR HER UNIQUE BACKGROUND, DEDICATION, DESIRE, MOTIVATION, ACTIONS, AND NUMEROUS OTHER FACTORS. YOU FULLY AGREE THAT THERE ARE NO GUARANTEES AS TO THE SPECIFIC OUTCOME OR RESULTS YOU CAN EXPECT FROM USING THE INFORMATION YOU RECEIVE ON OR THROUGH THIS WEBSITE OR PRODUCT. When you purchase our product, you understand that there is no guarantee that you will achieve any particular result or outcome using any of the ideas, tools, strategies or recommendations presented. We make no promises or warranties concerning your likelihood of success, performance, future earnings, business profits, marketing performance, customer growth or results of any kind. You understand that with any business endeavour there is an inherent risk, including a loss of capital and loss of customers and therefore you assume all responsibility for any such risk.  

6.2 Earnings Disclaimer: ANY EARNINGS OR INCOME STATEMENTS OR EXAMPLES SHOWN THROUGH OUR WEBSITE ARE ONLY ESTIMATES OF WHAT MIGHT BE POSSIBLE NOW OR IN THE FUTURE. THERE CAN BE NO ASSURANCE AS TO ANY PARTICULAR FINANCIAL OUTCOME BASED ON THE USE OF OUR WEBSITE. YOU AGREE THAT I AM NOT RESPONSIBLE FOR YOUR EARNINGS, THE SUCCESS OR FAILURE OF YOUR PERSONAL OR BUSINESS DECISIONS, THE INCREASE OR DECREASE OF YOUR FINANCES OR INCOME LEVEL, OR ANY OTHER RESULT OF ANY KIND THAT YOU MAY HAVE AS A RESULT OF INFORMATION PRESENTED TO YOU THROUGH OUR WEBSITE. YOU ARE SOLELY RESPONSIBLE FOR YOUR RESULTS.

6.4 No Therapeutic Relationship: The Program does not constitute medical, psychological, or therapeutic advice and is not a substitute for professional care.
6.5 Limitation of Liability: To the fullest extent permitted by law, Mishku Studio disclaims all liability for any direct, indirect, incidental, or consequential damages arising from your participation in the Program.

7. Termination

The Company reserves the right to terminate your access to the Program at any time if you breach these Terms and Conditions. In such cases, no refund will be provided.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

9. Miscellaneous

9.1 Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the Program and supersedes all prior discussions or agreements.
9.2 Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remainder shall remain in full force and effect.
9.3 Amendments: These Terms may be updated by Mishku Studio at any time. You will be notified of significant changes via email.
